DMCA Policy

Digital Millennium Copyright Act (“DMCA”) Takedown Notices

Press Sports respects the intellectual property rights of others. Per the DMCA, Press Sports will respond expeditiously to claims of copyright infringement on the Site if submitted to Press Sports’s Copyright Agent as described below. Upon receipt of a notice alleging copyright infringement, Press Sports will take whatever action it deems appropriate within its sole discretion, including removal of the allegedly infringing materials and termination of access for repeat infringers of copyright protected content.

If you believe that your intellectual property rights have been violated by Press Sports or by a third party who has uploaded materials to our application, please provide the following information to the designated Copyright Agent listed below:

  1. A description of the copyrighted work or other intellectual property that you claim has been infringed;
  2. A description of where the material that you claim is infringing is located on the App;

  3. An address, telephone number, and email address where we can contact you and, if different, an email address where the alleged infringing party, if not Press Sports, can contact you;

  4. A statement that you have a good-faith belief that the use is not authorized by the copyright owner or other intellectual property rights owner, by its agent, or by law;

  5. A statement by you under penalty of perjury that the information in your notice is accurate and that you are the copyright or intellectual property owner or are authorized to act on the owner’s behalf;

  6. Your electronic or physical signature.

Press Sports may request additional information before removing any allegedly infringing material. In the event Press Sports removes the allegedly infringing materials, Press Sports will immediately notify the person responsible for posting such materials that Press Sports removed or disabled access to the materials. Press Sports may also provide the responsible person with your email address so that the person may respond to your allegations.

If you receive a DMCA counter-notice, you must submit notice of a lawsuit or a court order barring the republishing of the material from either party within 14 days of receiving the counter-notice. If you do not provide a notice of a lawsuit or a court order barring the republishing of the material, we will republish the material to our Application.

DMCA Takedown Counter-Notice

Press Sports will give the allegedly infringing party the ability to dispute the takedown by submitting a counter notice. If you believe that your material has been removed by mistake or misidentification, please provide 500px with a written counter-notification containing the following information:

  1. Your name, address, telephone number, and email address (if any);

  2. A description of the material that was removed and the location on the website/application (e.g. the URL) where it previously appeared;

  3. A statement UNDER PENALTY OF PERJURY that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.

  4. A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, any jurisdiction in which you may be properly served, and that you will accept service of process from the person who filed the original DMCA notice or an agent of that person, and

  5. Your electronic or physical signature.

Upon receipt of a valid counter-notification, Press Sports will forward it to the Notifying Party who submitted the original DMCA notification. The original Notifying Party (or the copyright holder he or she represents) will then have fourteen (14) days to notify us that he or she has filed legal action relating to the allegedly infringing material. If Press does not receive any such notification within fourteen (14) days, we may restore the material to the App.

Repeat Infringer Policy

Press Sports will terminate the accounts of repeat Copyright Infringers. Generally, when content is removed that you posted because the copyright owner of that content sent us a takedown notice, it constitutes a copyright strike. If you receive three copyright strikes within a two-year period, your account will be terminated.
